My boyfriend has a full-time day job but is looking to get a second job part-time he pays 170.00 a week in child support now which is taken out of full-time job will child support also take out of the 2nd jobs pay check as well if he does get a second job?
With 2 jobs will child support take from both paychecks?
You did not give enough information but I will try to help the best I can.
If he is current on all his child support payment then the answer would be no.
If he has arrears then he needs to be sending in $50 extra to go to the arrears. He will have to have that set up with the child support agency to get it documented correctly or it will be just extra given as child support.

Reply:If the $170 per week is coming out of his paycheck now, and that all he is ordered to pay, then child support won't come out of his check he gets from his second job.
They can't withhold more than the specified amount in the court order.
Reply:I would say no. Now the bad news, if the mother finds out about the addition job, she could take him back to court. I know people who got pay raises and their ex took them back to court to get more. Good luck

if 170$ is leaving him in arrears because he doesnt make enuf to pay what he should then yes it will
if he is in arears then he needs to make a motion in court to have support based on his income (lowered)
if he takes a 2nd job, the ex will someday find out and take him back to court because if he makes more then he should be paying more.

Reply:child support doesn't go by how many jobs he has..they go by the amount of money he makes..so as long has his ex doesn't know he has two jobs and asks for a increase then he is OK..but if she asks for a increase they will investigate how much he makes total..
Reply:It really depends on his ex and her financial needs. If she is receiving any type of government support such as medical card, food stamps, rental assistance, it is possible that the income from the 2nd job can be considered. If she is the greedy out to get him type, it is also possible.
If their relationship now is sort of stable when it comes to how they behave to one another and she is not recieving government assistance, it is unlikely the 2nd income will be considered.
Reply:it depends on the ruling of the judge. they wouldn't take the 170 off him twice, but if he has a higher income, the judge might decide that if the child needs it, your boyfriend will have to pay a bit more child support.

Reply:Child support goes by his INCOME, no matter where it comes from. $170.00 a week is quite enough, that is over $600 a month. If ANYONE should get a job it's the custodial parent if SHE wants more money.
Reply:I will be honest with you if he was to be order to pay 21% of his total income, it would also come from his second check but since he is order to pay a certain amount of money which her you say is taken out of his check, he may as well be taken from the other one but you will have been paid excess of the amount he was order to pay and thus he may stop paying for a while to compensate for the overpaid you recieved unless you take him back to court for him to be ordered to pay more than what he is paying now. You have to prove that his has rate increase or earns more that the intial period that he was ordered to pay what he is paying now. So now what matter is that he has to pay you $170.00 every month unless he is ordered to pay more
Reply:NO The state will set an amount and that amount will be taken every month no matter how many jobs you have. If his child support is 170 it will still be 170 if he gets another job
